Competition counsel for ArcelorMittal. Representing ArcelorMittal in the first formal State aid procedure opened by the European Commission against Romania, relating to alleged State aid in the privatisation of Petrotub SA, now ArcelorMittal Tubular Products Roman SA, in 2003 (2007 - 2009). Advising ArcelorMittal with regard to other State aid allegations in Romania (2011 - ongoing).

 

Competition and State aid counsel to AUDI Hungaria Motor Kft., in a formal State aid procedure relating to investment aid. (2010 - ongoing).

Competition counsel for Deutsche Bahn. Deutsche Bahn had retained Michael for antitrust and State aid work under a framework agreement. The assignments are confidential, but often include key legal opinions (2006 - 2008).



Competition counsel for Ford Motor Company. Jointly with Martina Maier of Howrey, Michael advised Ford on the privatisation of Automobile Craiova and Daewoo Motors in Romania, where the Commission completed its formal State aid procedure in record time. (2007 - 2008,). Furthermore, Martina Maier and Michael Schütte advised Ford on the granting of investment aid, which was approved by the European Commission very swiftly, and is currently advising Ford in respect of training aid for the training program to be implemented for employees in Romania. (2008 – 2010).


Counsel for Qimonda AG. Represented Qimonda AG in the review procedure concerning the countervailing duties imposed on imports of semiconductors (DRAMs) produced by Hynix in Korea.  (2001 - 2008).



Lead competition counsel for Hegemann Group. Representing the Hegemann Group in relation to various competition matters concerning Volkswerft Stralsund and Peene-Werft.  Michael Schütte regularly advises the Hegemann group in competition and State aid matters (2006 - 2009).



Competition counsel for Aker ASA. Representing Aker before the European Court of First Instance in an action for the annulment of a recovery order by the European Commission relating to Kvaerner Warnow yard, a German subsidiary of Aker (1999 - 2009).



Competition counsel to Dortmund Airport. Representing Dortmund Airport in a formal procedure before the European Commission relating to the financing of the airport infrastructure as well as the funding of an incentive scheme for airlines (2004 - ongoing).


Competition counsel for the Land Mecklenburg-Vorpommern. Michael Schütte provided a legal opinion on the granting of financing to a fundamentally healthy company that was, however, suffering from not obtaining a bank loan in the credit crunch as a consequence of the worldwide financial crisis. The issue was to ensure that the granting of a loan would not constitute State aid under the EU rules, despite the fact that, if no loan was granted, the company might ultimately have gone into difficulties. (2008 - ongoing). Advising the Land Mecklenburg-Vorpommern in a State aid investigation regarding Hohe Düne, Rostock (2010 - ongoing).



Competition Counsel for Meyer Werft Papenburg. Representing Meyer Werft in various competition, State aid and EU law matters. (since 1998, ongoing).



Trade Counsel to Vallourec&Mannesmann Tubes. Advising two companies of the Vallourec&Mannesmann Tubes group in an anti-dumping procedure concerning the imports of seamless tubes from the People’s Republic of China into the EU. (2008 – 2009). Advising in a review procedure concerning imports from Russia (2011 - ongoing).
